Sitting Pretty In The Four Corners Of The Contract: Identifying Employees And Independent Contractors

Classifying a worker as an employee or an independent contractor can be a challenging task. This difficulty has traditionally required an extensive review of the entire working relationship to determine its legal character. However, two long-awaited decisions of the High Court have clarified that – in certain circumstances – the analysis should be confined to the written terms of the contract as distinct from the subsequent conduct of the parties.
