Performance and conduct management is one of the most important capabilities for any manager. Minimise business risk and build your team’s confidence in managing performance and conduct by attending our highly regarded full-day workshop.

Led by Jasmine O’Brien, Principal of Sladen Legal’s Employment Law team, this practical and interactive workshop will equip you with the skills to manage performance and conduct effectively to minimise risk and costs to the business.

The workshop will be set against the backdrop of artificial intelligence. Jasmine will explore how AI is reshaping employers’ interactions and relationships with employees, and the broader employment law landscape. In a world where every employee has access to AI-generated “legal” advice, she will discuss what employers need to consider when managing performance and conduct.

The workshop will cover:

  • distinction between performance and conduct;

  • how to have performance and conduct management discussions;

  • managing employees’ performance and conduct in an increasingly remote workplace;

  • navigating AI when managing employee performance and conduct and emerging employment law trends;

  • the availability of workplace surveillance technology to manage performance and conduct;

  • strategies to have informal performance management discussions;

  • how to complete a performance improvement plan;

  • conducting a workplace investigation;

  • how to structure and organise a serious performance or conduct meeting (i.e. where / how / when);

  • completing a file note; and

  • alternatives to termination when there has been a breakdown in the employment relationship.

The workshop combines mini-lectures, practical coaching, storytelling and interactive activities. Attendees will also receive high-quality take-home materials, including template documents designed to be an ongoing resource for their business. This is one of the most valuable benefits of the workshop, helping attendees put their learning into practice long after the session ends.

Attendees will leave the workshop with an ability to:

  • recognise the importance of coaching and counselling employees before a formal disciplinary process is needed;

  • understand what constitutes reasonable management action in the context of performance and conduct management;
