Long Service Leave Act 2018 (Vic)

On 15 May 2018, the Long Service Leave Act 2018 (Vic) (Act) received Royal Assent by the Victorian Parliament. The Act will apply to all employees in Victoria, unless they are explicitly excluded.

Key changes

Key changes include:

  • allowing long service leave to be taken at a minimum of one day at a time;

  • allowing long service leave to be taken after seven years;

  • providing that a period of unpaid parental leave up to 12 months (or longer if agreed) will not break an employee’s continuous employment for the purpose of access to long service leave;

  • preserving leave entitlements during transfer of business by expanding the definition of “assets” to include intangible assets;
    adding a third option for calculating average weekly hours over the entire period of continuous service for long service leave entitlement, whereby the hours worked are averaged across the full period of employment.

The Act commences operation on 1 November 2018.
