Prof Jeff Waincymer will address the argument proffered by V.V Veeder that while arbitration flows from the consent of the parties, tribunals must thereafter control procedural integrity such as extensions, admissions of new claims, sua sponte rights to examine corruption, apply mandatory law, etc. Jeff will take the argument further to the third stage of supervisory jurisdiction control which has a reverse impact. Arbitral tribunals will not do what they think supervisory courts will overturn - the stultifying effect of due process paranoia.
